This Privacy Policy (the “Privacy Policy”) explains how Black & White Zebra Industries Inc., doing business as BWZ Revstacks (“Company”, “we”, “us”, “our”), handles Personal Data that you (“user”, “you”, “your”) provide to us or which we otherwise collect when you access and use our website and services located at https://vendor.revstacks.com (collectively, the “Services”).

Definitions

Personal Data” means any information relating to an identifiable individual, including without limitation, names, addresses, e-mail addresses, phone numbers, photographs and online identifiers.

Process” or “Processing” means any action that a person can take with respect to Personal Data, including collecting, using, sharing, and altering Personal Data.


What Personal Data We Collect

Personal Data that we may collect through your use of the Services includes, without limitation, the following:

(a) Website Visits. Whenever a user visits the website, we receive the following information:

(i) Technical information regarding the ways in which users interact with the website. This includes the IP (internet protocol) address used to connect to the user’s computer to the internet, the operating system used by the user’s computer, the type and version of browser used to access the website, browser plug-ins and extensions present on the browser, and time zone settings;

(ii) Interaction information regarding a user’s actions when on the website, as well as how they got to the website and where they go after leaving the website; and

(iii) Personalization information collected both from our website and based upon the existing cookies a user has stored in their internet browser.

(b) Log-Ins and Registrations. When a user registers or logs into an account on the website, they must verify their identity through logging in via their LinkedIn profile details. Through LinkedIn, we collect the following profile information:

(i) Name;

(ii) Email address;

(iii) Profile URL;

(iv) Profile picture;

(v) Job title;

(vi) Company name;

(vii) Company size; and

(viii) Company industry.

(c) Downloads from Website. If a user would like to download one of our white paper documents, they must first provide the following information via webform:

(i) Name;

(ii) Company name;

(iii) Email address; and

(iv) Phone number.

(d) Software Recommendations. If a user would like to take advantage of our software recommendation or advisory services, they must provide the following information via webform:

(i) Name;

(ii) Company name;

(iii) Company size;

(iv) Company industry;

(v) Software requirements;

(vi) Email address; and

(vii) Phone number.

(e) Listing Products. If a user would like to list their company’s products via the vendor panel, they must provide the following information via webform:

(i) Name;

(ii) Company name;

(iii) Product descriptions, screenshots and other details;

(iv) Email address;

(v) Phone number; and

(vi) Payment data for premium services.

These forms contain fields specified with an asterisk (*) that must be filled in, as they are mandatory and necessary. Failing to submit this information will result in failure to download the desired document and/or failure to obtain the applicable product or service. Users are also advised that any inaccuracy, falsity, mistake, or error in any submitted information is their exclusive responsibility. We also advise users to inform us of any change in their Personal Data so as to keep up-to-date, error-free profiles.


Why We Collect Personal Data / How We Use Personal Data

We may collect Personal Data in order to fulfill the following purposes (the “Purposes”):

(a) to provide our Services to you or our clients, including without limitation, software comparison services and marketing campaigns;

(b) to respond to your communications with us;

(c) to contact you about updates to the Services, marketing and promotional offers, and service-related communications;

(d) for internal statistical and operational purposes to better understand how our Services are used;

(e) to improve our Services, including with respect to security and function; and

(f) to carry out any other purpose which is disclosed to you and for which you consent, or as is otherwise permitted by applicable law.

More specifically, our use Personal Data may include:

(i) Business Relationships

  • When a user consumes content on our website or some of our partner sites, we may use their IP address and cookies or similar technologies (in some cases) to collect anonymous user profiles that indicate organizational interest in specific types of products or services. We may then provide this account-level data to our clients for general analytics, marketing or advertising purposes. However, we do not provide user-level browsing data or IP address data directly to clients. If you would like to opt out of this, please contact us as provided at the end of this Privacy Policy. You can opt out retroactively and/or going forward and request any past data collected about your IP address to be permanently deleted.

(ii) Marketing

  • We will send promotional emails to users based on their account preferences (which may be changed in the account settings). This includes an email newsletter program, notifications regarding review rewards, as well as changes to administrative information such as terms, conditions, and policies.
  • Email marketing campaigns published by this website or its owners may contain tracking facilities within the actual email. Subscriber activity is tracked and stored in a database for future analysis and evaluation. Such tracked activity may include, without limitation: the opening of emails; forwarding of emails; the clicking of links within the email content; as well as times, dates, and frequency of activity. This information is used to refine future email campaigns and supply the user with more relevant content, based on their activity. Subscribers are given the opportunity to unsubscribe at any time through an automated system. This process is detailed in the footer of each email campaign. If an automated unsubscription system is unavailable, clear instructions on how to cancel a subscription will be detailed instead. Should an error occur and no link or instructions are displayed, users are advised to contact us and the subscription will be canceled manually.

Grounds for Processing Personal Data

The type of consent we may rely on in processing your Personal Data will vary based on your reasonable expectations, the sensitivity of your Personal Data, and the circumstances surrounding the collection of your Personal Data. We will have no liability associated with any such disclosures made in good faith.

(e) International Transfer and Storage. Your Personal Data may be stored and processed in any country where we have facilities or in which we engage third party service providers. By using our Services and otherwise providing us your Personal Data, you consent to the transfer of your Personal Data to countries outside of your country of residence, which may have different data protection rules than in your country. While such information is outside of the Canada, it is subject to the laws of the country in which it is held, and may be subject to disclosure to the governments, courts or law enforcement or regulatory agencies of such other country, pursuant to the laws of such country. If applicable, we will comply with the GDPR requirements providing adequate protection for the transfer of Personal Data from the European Economic Area to a third country.


Retention of Personal Data

Our data retention periods may vary depending on the country in which you receive Services and applicable law. We will securely delete or anonymize the Personal Data once it is no longer necessary for us to hold it. (b) European Union. If you are an individual to whom the GDPR applies, then you have the following additional rights relating to your Personal Data, subject to applicable law in each instance:

(i) Right to Erasure. To request the deletion of Personal Data when: (A) you believe it is no longer necessary for the purposes collected; (B) you withdraw your consent or object to the processing of your Personal Data; or (C) your Personal Data was unlawfully processed.

(ii) Right to Restriction of Processing. To restrict the processing of Personal Data if you dispute its accuracy or object to its processing.

(iii) Right to Portability. To request that your Personal Data be transferred to another organization.

(iv) Right to Information about Automated Decision Making. To receive information about the basis of any automatic decision making (e.g., algorithms).

(v) Right not to be Subject to Automated Decision Making. To not be subject to decisions based solely on automated processing, unless this is necessary pursuant to a contract between us.

(vi) Right to Object to Processing Activities. To object to the processing of your Personal Data based on our legitimate interests.

(c) California Residents. To the extent that the CCPA applies to our Services, this section governs our collection and use of “Personal Information”, as defined under the California Consumer Privacy Act (2018), as amended (the “CCPA”), if you are a resident of California. As used in the CCPA, “Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular California resident or household.

(i) Your Rights. As a resident of California, you have certain rights with respect to your Personal Information, subject to applicable law in each instance:

(A) Right to Know. You have the right to request information on the categories of Personal Information that we collected in the previous twelve (12) months, the categories of sources from which the Personal Information was collected, the specific pieces of Personal Information we have collected about you, and the business and/or commercial purposes for which such Personal Information is collected and shared. (B) Right to Delete. You have the right to request us to delete Personal Information that we collected from you.

(C) Right to Opt-Out. You have the right to opt-out of the “sale” of your Personal Information to third parties. A “sale” for the purposes of the CCPA means selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating, of Personal Information to a third-party for monetary or other valuable consideration. This includes the terms: “sell”, “selling”, “sale”, or “sold”. Except as may otherwise be provided in this Privacy Policy, we will only sell Personal Information pursuant to a separate written agreement signed by you and the Company.

(D) Right to Non-Discrimination. You have the right to not receive discriminatory treatment when you exercise your California privacy rights (e.g., denial of goods or services, provision of a different level, quality or price for goods or services). However, notwithstanding the foregoing, different service levels and prices may be provided if such difference is reasonably related to the value provided by the Personal Information.
